1. INFORMATION FOR THE USER

Who is responsible for the processing of your personal data?

The State Foundation for Health, Childhood and Social Welfare F.S.P (Fundación CSAI) is the CONTROLLER of the USER’s personal data and informs you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

For what purpose do we process your personal data?

To maintain a commercial relationship with the user. The planned operations for processing include:

• Sending commercial advertising communications via e-mail, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that allows commercial communications. These communications will be carried out by the CONTROLLER and will be related to its products and services, or those of its partners or suppliers with whom promotional agreements have been reached. In this case, third parties will never have access to personal data.
• Conducting market research and statistical analysis.
• Processing orders, requests, responding to inquiries, or any type of request made by the USER through any of the contact forms provided on the CONTROLLER’s website.
• Sending the online newsletter with updates, offers, and promotions related to our activities.

Why can we process your personal data?

The processing is legitimized by Article 6 of the GDPR as follows:

• With the USER’s consent: sending commercial communications and the newsletter.
• Based on the CONTROLLER’s legitimate interest: conducting market studies, statistical analysis, and handling requests made by the USER.

How long will we keep your personal data?

The data will be kept no longer than necessary to maintain the purpose of the processing or as long as there are legal requirements mandating their custody. When they are no longer necessary, they will be deleted with appropriate security measures to ensure data anonymization or complete destruction.

To whom do we provide your personal data?

No communication of personal data to third parties is foreseen, except if necessary for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the CONTROLLER has confidentiality and data processing contracts in accordance with current privacy regulations.

What are your rights?

The USER’s rights are:

• The right to withdraw consent at any time.
• The right of access, rectification, portability, and erasure of their data, and to restrict or object to its processing.
• The right to lodge a complaint with the supervisory authority (www.aepd.es) if they consider the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF INFORMATION PROVIDED BY THE USER

By ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or in download forms, USERS expressly and freely accept that their data are necessary for the provider to handle their request, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the CONTROLLER are truthful and is responsible for communicating any modification of them.

The CONTROLLER informs that all data requested through the website are mandatory, as they are necessary to provide the USER with an optimal service. If not all data are provided, it cannot be guaranteed that the information and services provided will fully meet their needs.

3. SECURITY MEASURES

In accordance with current regulations on personal data protection, the CONTROLLER is complying with all provisions of GDPR and LOPDGDD for the processing of personal data under its responsibility, and explicitly with the principles described in Article 5 of the GDPR, under which the data are processed lawfully, fairly, and transparently in relation to the data subject, and are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.

The CONTROLLER guarantees that appropriate technical and organizational policies have been implemented to apply the security measures required by GDPR and LOPDGDD in order to protect USERS’ rights and freedoms, and has provided them with the necessary information so they can exercise these rights.
